Before You Buy (the "Service") is provided by Jamie Ashley Stott ("we", "us", "our"), a sole trader based in the United Kingdom, trading as Before You Buy. By creating an account or continuing to use the Service you enter into a contract with Jamie Ashley Stott on these terms. If you do not agree with them, please stop using the Service.
1. The Service
Before You Buy analyses publicly available and historical pricing signals, seasonal patterns and product release cycles to produce a "buy now" or "hold" recommendation, price forecasts, saved product watchlists and price alerts. Free and Premium plans are described on our pricing page.
2. Eligibility and your account
You must be of legal age to form a binding contract, and where you use the Service on behalf of an organisation you confirm you have authority to bind it. You must provide accurate registration information, keep it up to date, and keep your credentials confidential. You are responsible for all activity under your account.
3. Licence and restrictions
We grant you a limited, non-exclusive, non-transferable right to use the Service within the plan you have selected. You must not reverse engineer the Service, resell or redistribute it, or circumvent technical or plan limits.
4. Acceptable use
You must not misuse the Service. In particular, you must not:
- use it for any unlawful purpose or in breach of applicable law;
- commit fraud, send spam, or impersonate any person or organisation;
- infringe the intellectual property or privacy rights of others;
- interfere with the security or integrity of the Service, including introducing malware, probing or scanning our systems, or scraping the Service at scale.
5. No advice; accuracy of recommendations
Recommendations, forecasts and price data are provided for general information only. They are estimates generated from historical and modelled data and may be inaccurate or out of date. They are not financial advice or a recommendation to enter into any transaction, and purchasing decisions remain entirely your own responsibility. Always verify the current price and terms with the retailer before buying.
6. Retailer links
The Service may display links to third-party retailers, some of which are affiliate links that may earn us a commission at no additional cost to you. We are not the seller of those products and are not responsible for third-party sites, prices, stock or fulfilment.
7. Intellectual property
We retain ownership of the Service and all intellectual property in it, including software, models, documentation, content and branding. Where you submit content to the Service, you grant us a limited licence to host and process it solely to provide the Service to you.
8. Payment, subscriptions and taxes
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, currency, tax, renewal, cancellation and refund mechanics are governed by the Paddle Buyer Terms. Premium subscriptions renew automatically each billing period until cancelled; you may cancel at any time and keep access until the end of the paid period. See our refund policy for refund rights.
9. Service level
We work to keep the Service available, but we do not guarantee uninterrupted or error-free performance. Features may change, and we may perform maintenance or withdraw features on reasonable notice.
10. Warranties and liability
To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose. We are not liable for indirect or consequential loss, including loss of profits, data or goodwill, and our aggregate liability is limited to the fees you paid in the twelve months before the claim. Nothing limits liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded by law.
You will indemnify us against claims arising from your unlawful use of the Service, your content, or your breach of these terms.
11. Suspension and termination
We may suspend or terminate access for material breach of these terms, non-payment, a security or fraud risk, or repeated or serious policy violations. You may close your account at any time from the account page. On termination your access ends and your data is deleted or anonymised in line with our privacy notice; you may export saved products before closing your account.
12. Changes, assignment and force majeure
We may update these terms; material changes will be notified in the app or by email. You may not assign these terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets. Neither party is liable for delays caused by events beyond its reasonable control.
13. Governing law and contact
These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction. For questions about these terms, contact Jamie Ashley Stott through the support channel in the app. Billing and order queries are handled by Paddle at paddle.net.
